These Terms of Service ("Terms") govern your use of BOTSIZA (botsiza.com), an AI chatbot service for South African businesses. By creating an account, subscribing, or using the service, you agree to these Terms.

We may also offer once-off top-ups (additional credits on demand) via PayFast. Top-up credits do not expire for 12 months.
Subscriptions are billed monthly via PayFast debit order. You may cancel at any time from your Owner dashboard or by emailing us. Cancellation takes effect at the end of the current billing month — you retain access for the days you've already paid for. We do not pro-rate partial-month refunds, except where required by the Consumer Protection Act (CPA section 16: 5-day cooling-off for distance-sale agreements applies to your first month).
You agree not to use BOTSIZA to:
We reserve the right to suspend or terminate accounts that violate these rules, with refund of unused subscription days.
Yours: Your business name, logo, and the knowledge files you upload remain yours. You grant us a non-exclusive licence to use them solely to operate the service for you.
Ours: The BOTSIZA platform, software, prompts, designs, and underlying tooling remain ours. The bots and their personalities are ours; you receive a licence to use them while subscribed.
Bot replies: AI-generated text is provided as-is. You are free to use bot replies in your business communications. We do not claim copyright over generated text.
You acknowledge that visitors who chat with your bot may share personal information. As the Owner, you are jointly responsible (with us) for handling that information lawfully under POPIA. We provide tools (lead inbox, deletion controls) — you must not misuse the contact details captured.
We aim for high availability but do not guarantee 100% uptime. Scheduled maintenance is announced in advance. Unscheduled outages (e.g. third-party API failures from Anthropic, Cloudflare, PayFast, Hetzner) may occur — we credit affected accounts proportionally for outages exceeding 4 consecutive hours.
BOTSIZA bots use Anthropic's Claude language models. Replies are AI-generated and may contain inaccuracies. Bots are explicitly instructed to defer to qualified professionals on regulated topics (medical, legal, financial, electrical, gas). Owners are responsible for reviewing and acting on lead information appropriately. We do not guarantee the accuracy of any individual bot reply.
To the maximum extent permitted by South African law, our total liability to any Owner in any 12-month period is limited to the subscription fees paid by that Owner in the preceding 12 months. We are not liable for indirect, consequential, or special damages, including lost business or lost profit. Nothing in these Terms excludes liability for fraud, gross negligence, or matters that cannot lawfully be excluded under the Consumer Protection Act.
You may terminate at any time. We may terminate for breach of these Terms with 7 days notice (or immediately for serious breach). On termination we will delete your account data within 30 days, except where retention is required by law (e.g. tax records).
We may update these Terms. Material changes will be emailed to active Owners 14 days before they take effect. Continued use after the effective date constitutes acceptance.
These Terms are governed by the laws of the Republic of South Africa. Disputes will be resolved in the South African courts of competent jurisdiction. Where the Consumer Protection Act applies (i.e. you are a consumer rather than a business), you may also approach the National Consumer Commission.
